May 31, 2001Q: Can communities require residents to remove snow and ice from sidewalks surrounding their property?
A: Yes. State law (M.G.L. Ch. 85, Sect. 5) authorizes cities to enact by ordinance and towns to enact by bylaw provisions for removal of snow and ice from sidewalks by the owner or resident of land abutting the sidewalks. Cities and towns establish the time and manner of snow and ice removal in such ordinances and bylaws. Fees for failure to comply may be collected. Such fees cannot exceed $50 in cities and $10 in towns for each violation.
